Terms of Service
In short.
- The Service is in a private test and is provided as is.
- Your material and your videos are yours. You are responsible for what you upload and what you publish.
- What you upload is processed by third-party AI services, which may use it to train their models.
- Check every video before you approve it. Generated content can contain mistakes.
1. These terms
These Terms of Service govern your use of Explainer Engine at explainerengine.me (the "Service"), operated by its developer, an individual based in the State of Illinois, USA ("we", "us"). By using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use it
You must be at least 18 years old and able to enter into a binding agreement. The Service is currently available by invitation only. If you use it for an organization, you confirm that you may accept these terms on its behalf.
3. The Service
The Service turns study material into explainer videos and can publish them to accounts you connect. It is in a private test: features may change, pause or end, and we do not promise that it will be available at any particular time or free of errors.
4. Your account
Keep access to your e-mail account secure, because sign-in links are sent there. You are responsible for what happens under your account. Tell us right away if you think someone else has used it.
5. Your content
- You keep your rights. As between you and us, you own the material you upload and the videos and texts the Service makes for you, to the extent the law allows.
- Permission to run the Service. You let us store, copy, process and transmit your content, including through our service providers, only as needed to provide the Service to you and to publish what you approve.
- AI services and model training. You agree that your content and the content made from it are sent to third-party AI services, which may keep it and use it to train and improve their models. Upload nothing you are not willing to share this way.
- Your promises. You have the rights to everything you upload. You have the consent of every person whose photo, name or voice you use to create a presenter. Your content does not break the law or anyone else's rights.
6. Generated content
Scripts, voices, drawings and videos are generated automatically and can contain factual errors, omissions or unintended similarities to other works. You review every draft and every final video, and you decide what to publish. You are responsible for what you publish and for its accuracy.
7. Publishing platforms
When you connect YouTube, Instagram, TikTok or another platform, that platform's own terms apply to your account and your videos, including the YouTube Terms of Service. We are not responsible for what a platform does, such as rejecting, limiting or removing a video, restricting your account, or changing its rules or limits.
8. Paid third-party services
We do not take payments. If you give the Service your own key for a paid third-party service, such as a voice service, that service bills you under its own terms. The Service asks for your approval before it starts a paid step, and you are responsible for the charges that follow your approval.
9. Acceptable use
Do not use the Service to:
- make content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit, or dangerously misleading;
- impersonate a real person, or create a presenter that looks or sounds like a real person without their consent;
- send spam or mass-produce videos meant to mislead viewers or platforms;
- break, overload, probe or get around the security of the Service, or access other people's accounts or data;
- copy, resell or reverse engineer the Service.
10. Suspension and ending
You can stop using the Service at any time and ask us to delete your data, as described in the Privacy Policy. We may suspend or end your access at any time, including if you break these terms or if we stop offering the Service. Sections 5 to 7 and 11 to 15 continue to apply after your access ends.
11. Disclaimer
THE SERVICE AND EVERYTHING IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, AUDIENCE OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR OF ANYTHING IT PRODUCES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND FIFTY US DOLLARS (USD 50).
13. Indemnity
You agree to defend and hold us harmless from claims, losses and costs, including reasonable attorneys' fees, that arise from your content, what you publish, or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. Any dispute related to these terms or the Service will be resolved only in the state or federal courts located in Illinois, and you and we consent to their jurisdiction.
15. General
If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term, we do not give up the right to enforce it later. You may not transfer these terms without our consent; we may transfer them as part of a transfer of the Service. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
16. Changes
We may update these terms. We will post the new version here with a new effective date, and tell you by e-mail before a material change takes effect. If you keep using the Service after that, you accept the new terms.
